NextGen Equipment Finance, LLC (“NextGen,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect through nextgenequipmentfinance.com (the “Site”), through our financing and leasing services, and through our other business interactions with you, how we use and share that information, and the choices you have.
By using the Site or providing information to us, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.
1. Who We Are
NextGen provides equipment financing, leasing, vendor finance, and asset management solutions to businesses. NextGen is part of a family of affiliated companies that includes:
- TFS Ltd. (tfsglobal.com), a fleet management company based in Perrysburg, Ohio; and
- Velocity (velocityteam.com), a material handling maintenance, facility design-build, and warehouse solutions company.
In this policy, TFS and Velocity are referred to as our “Affiliates.”
2. Information We Collect
Information you provide to us
- Contact and inquiry information: name, email address, phone number, company name, job title, and the content of messages you send through our contact form, by email, or by phone.
- Financing and credit application information: business name, address, tax identification number, years in business, ownership information, bank references, trade references, financial statements, tax returns, and details about the equipment you want to finance.
- Owner and guarantor information: if an owner, officer, or guarantor is part of a financing request, we may collect that individual’s name, home address, date of birth, Social Security number, and personal financial information.
- Account and transaction information: lease and loan agreements, payment history, billing and remittance details, equipment location, and insurance information.
- Employment information: if you apply for a job, your resume, work history, and related information you choose to provide.
Information from third parties
- Business and consumer credit reports, credit scores, and identity verification results from credit bureaus and verification providers, obtained with your authorization where required by law.
- Information from equipment vendors, dealers, and manufacturers who refer you to us or participate in your transaction.
- Information from our Affiliates when you are also a customer or prospect of theirs.
- Publicly available business information.
Information collected automatically
When you visit the Site, we and our service providers may automatically collect information such as your IP address, browser type, device type, operating system, referring website, pages viewed, time spent on pages, and general location. We collect this through cookies, web beacons, and similar technologies. See Section 7 for more on cookies.
3. How We Use Information
We use the information we collect to:
- respond to your questions and requests;
- evaluate, process, and underwrite financing and lease applications;
- verify identity, assess creditworthiness, and prevent fraud;
- document, fund, service, and administer leases and loans, including billing, collections, and end-of-term processing;
- communicate with you about your account and our services;
- send marketing about NextGen and Affiliate products and services, subject to your choices described below;
- operate, secure, analyze, and improve the Site;
- evaluate job applicants;
- comply with legal, regulatory, tax, and accounting obligations; and
- protect our rights, property, and safety and those of our customers and others.
4. How We Share Information
We do not sell your personal information. We share information only as described below:
- With our Affiliates. We may share contact, inquiry, and account information with TFS and Velocity so they can provide related services you request, support your equipment and fleet needs, and tell you about their products and services. You may opt out of Affiliate marketing as described in Section 8. We do not share Social Security numbers, credit reports, or personal financial statements of individuals with our Affiliates for their marketing purposes.
- With financing and transaction partners. We may share application and transaction information with banks, funding sources, investors, assignees, and syndication partners that fund, purchase, or participate in a lease or loan, and with the equipment vendor or dealer involved in your transaction.
- With credit bureaus. We may request credit reports and may report payment and account information to credit bureaus and business credit reporting agencies.
- With service providers. We share information with companies that perform services for us, such as website hosting and development, CRM and email platforms, document management and e-signature, payment processing, analytics, insurance tracking, collections, accounting, and legal services. These providers may use the information only to perform services for us.
- For legal reasons. We may disclose information when we believe it is required by law, subpoena, or court order, or to protect our rights, investigate fraud, or protect the safety of any person.
- Business transfers. If NextGen is involved in a merger, acquisition, financing, or sale of assets, including the sale or assignment of lease or loan portfolios, information may be transferred as part of that transaction.
- With your consent. We may share information for other purposes with your permission.
5. Credit Information and Guarantors
Our financing is offered for business and commercial purposes. When an individual owner or guarantor is part of a transaction, we obtain consumer credit reports only with that individual’s authorization and use them only for permissible purposes under the Fair Credit Reporting Act, such as evaluating, reviewing, and collecting the financing. We limit access to personal financial information to employees and service providers who need it to process and service the transaction.
6. Text Messages
If you agree to receive text messages from us, we will use your mobile number to send messages related to your request or account. Message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. We do not share mobile numbers or text messaging opt-in consent with third parties or Affiliates for their marketing purposes.
7. Cookies and Analytics
We use cookies and similar technologies to keep the Site working, remember your preferences, understand how visitors use the Site, and improve our content. We may use analytics services such as Google Analytics, which collect information about your use of the Site. You can learn how Google uses data at policies.google.com/technologies/partner-sites and opt out with the Google Analytics opt-out browser add-on.
Most browsers let you block or delete cookies. If you do, parts of the Site may not work properly. The Site does not currently respond to browser “Do Not Track” signals.
8. Your Choices
- Marketing email: use the unsubscribe link in any marketing email, or contact us using the information below.
- Affiliate marketing: to opt out of our sharing your information with TFS and Velocity for their marketing, email support@nextgenteam.com with the subject line “Affiliate Opt-Out.”
- Updating your information: contact us to review or correct your contact information.
Even if you opt out of marketing, we may still send you messages about your application, account, or transaction.
9. Your Privacy Rights
Depending on where you live, you may have rights under applicable state or international privacy laws, which may include the right to:
- know what personal information we have collected about you and how we use and share it;
- access or receive a copy of your personal information;
- correct inaccurate personal information;
- request deletion of your personal information, subject to legal exceptions;
- opt out of targeted advertising or any sale of personal information (we do not sell personal information); and
- not be discriminated against for exercising these rights.
To make a request, contact us using the information in Section 14. We will verify your identity before responding and will respond within the time required by applicable law. You may use an authorized agent where the law permits. If we deny your request, you may appeal by replying to our response with the subject line “Privacy Appeal.”
Some information, such as information subject to the Gramm-Leach-Bliley Act or the Fair Credit Reporting Act, or information we must keep for legal, tax, audit, or contractual reasons, may be exempt from some of these rights.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls, encryption where appropriate, and restricting sensitive information to those who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send Social Security numbers or financial statements through our general website contact form; ask us for a secure submission method instead.
11. Data Retention
We keep personal information for as long as needed to fulfill the purposes described in this policy, including for the life of a lease or loan and for the period afterward required by law, regulation, tax, audit, or our contractual obligations to funding partners. When information is no longer needed, we delete or de-identify it.
12. Children’s Privacy
The Site and our services are intended for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
13. Third-Party Links
The Site may link to websites operated by others, including our Affiliates. Their privacy practices are governed by their own policies, which we encourage you to review:
